CCUA Member Testimonials

Kam O‘Neill, Senior Litigation Associate (Financial Services Disputes & Investigations):

“I contacted CCUA to request assistance with obtaining information about the progress of our client’s urgent application to set aside default judgment and to stay enforcement proceedings. The application had been filed and processed by the Online Money Claims Court (OMCC) but for several months we were being informed by Court staff that there was no update on the progress of our client’s application. In the meantime, the vexatious opponent issued a statutory demand against our client and threatened to wind up our client’s company for non-payment of the judgment debt.

“CCUA Chair Rob Thompson understood the urgency of the matter and was able to promptly liaise with the OMCC to get our client’s application before the District Judge. Within a matter of days, the application was expedited and the Court was able to review it and grant the set aside order. Rob kept me updated at all times and was able to obtain a copy of the Court’s Order in advance of it being sent to the firm in the post.

“The consequence of this intervention was that our client was saved the cost and time of applying for an emergency application to restrain the other party from presenting a winding up petition. Due to the industry in which the client operates, a winding up petition would have had catastrophic consequences for our client. Rob’s persistence in pursuing this matter with his contacts at the Court cannot be understated. The team at the CCUA offer a thoroughly beneficial service to its users.
