The Civil Court Users Association (CCUA) believes The Taking Control of Goods (Fees) Regulations 2014 contained a mechanism for annual increases to adjust for inflation. This mechanism was widely supported during the preceding consultation, by a wide range of stakeholders, yet such adjustments have not so far been implemented.
It is only right that fair fees are paid to those in the enforcement sector. However, it is of even greater importance that enforcement has sufficient resourcing, so that standards can be maintained for the benefit of all involved in the legal process, including both Judgment Creditor and Judgment Debtor.
The Association has therefore now written to the Secretary of State for Justice, in a joint letter together with other bodies representing court users, requesting that this situation should now be addressed.
