The current personal insolvency framework is based on recommendations made over 40 years ago. While the framework has been added to on an ad hoc basis over the years, there has been no wider consideration of the regime. In response to a previous consultation on personal insolvency matters, stakeholders called for a full review of the insolvency framework, which the Government agreed, starting with a call for evidence.

The Civil Court Users Association (CCUA) notes that the current remedies available for personal insolvency have developed and evolved over time, following relatively regular reviews to ensure that they remain relevant and fit for purpose. Accordingly, whilst improvement could no doubt be made, they currently provide a proportionate, effective and balanced approach.
