HM Courts & Tribunals Service’s (HMCTS) Civil National Business Centre (CNBC) has issued clarification regarding the Writs currently being processed through its centralised service.
At present, it is only handling Combined Requests for Writs of Control—these are applications where the certificate of judgment and Writ request are submitted together, typically for enforcement of County Court Judgments (CCJs). This centralised process is managed by CNBC and is designed to streamline enforcement and reduce delays.
The clarification comes in response to a number of applications being returned and queries regarding this from court users. These returned Writs are Writs of Possession, which are not yet part of the centralised process. Possession Writs still require handling by the local courts, as they involve specific judicial oversight and hearing requirements that CNBC is not currently authorised to manage.
This distinction is important to avoid delays and ensure applications are directed appropriately. It is hoped that CNBC can bring on board other types of Writs but arrangements are still being worked through with the judiciary and local courts. CCUA members will be kept updated as this progresses.
