The Court of Appeal has scheduled a hearing of CILEX’s appeal against the Mazur judgment, which will be live streamed on the Judiciary’s youtube channel (https://www.youtube.com/channel/UCi3XytDJY8a3I9_vL7A_5SQ) for CCUA Members and others to view.

 

According to CILEX, the 2025 High Court judgment caused confusion and uncertainty for those working in litigation by finding that non-authorised staff cannot “conduct” litigation – such as issuing or managing court proceedings – simply by being employed by an authorised firm. It ruled that supervision by an authorised person does not permit non-qualified staff to conduct litigation, requiring both the firm and the individual to be authorised.

CILEX says that the issues raised by the judgment “go to the heart of access to justice, fairness and diversity within the legal profession, and the efficient operation of the legal system.” Its appeal calls for urgent clarity and certainty, recognising the expertise and authorisation of experienced legal professionals.
